Making A Complaint

There are rigid rules to be followed in bringing a complaint of a human rights violation before the Human Rights Committee. The most important one is that all domestic legal avenues up to the highest court in the land must have been pursued before the Committee will even consider the complaint. Many complaints are lodged each year by individuals and groups but only a very few ever get accepted for hearing. When the Committee upholds a complaint, this has the force of a ruling in international law.

Non-government organizations supported by a few governments have proposed a similar Optional Protocol to the International Covenant on Economic, Social and Cultural Rights. There is much resistance to this proposal and it will be some time before it has any chance of adoption.
