On 9 August 2006, the authorities of central Sulawesi, Indonesia, have fixed the date and place for the death penalty execution of Tibo, Marinus and Dominggus. It will take place on 12 August 2006 (Saturday) at 0015 in Palu. The three Indonesian Catholics were accused for masterminding the massacre of 200 Muslims in Poso during inter-religious clashes in 2000.

In response to the execution, a statement/appeal was issued by the religious leaders of central Sulawesi, including K.H.Arifin Assagaf (Ketua Majelis Ulama, Indonesia Sulawesi Utara), Mgr. Josef Suwatan MSC (Uskup Keuskupan Manado), and Pdt. Dr. Nico Gara, MA (President of Asia Fellowship of Mission 21 Partner Churches, Vice President of International Synode of Mission 21). It condemns the injustice and lack of material truth of the execution, and appeals to the law enforcement officers to pay attention to the case. (Please see below)

HUMANITY APPEAL
FOR THE SAKE OF TRUTH AND JUSTICE
FOR TIBO, MARINUS AND DOMINGGUS

Due to death penalty execution to Tibo, Marinus and Dominggus, scheduled on August 12th 2006, we must admit that the news disturbed our feeling of justice and humanity. The reason is because the law enforcement officer never used new facts (novum) as clearly be found on trial process at Palu State Court dated March 9th 2006 to get material truth on this case. We, community and religious leader, hereby appeal:

  1. Life is fundamental human rights that can not be seized by any means by everyone as it’s guaranteed in world’s convention on human rights and must be also guaranteed in Republic of Indonesia’s Laws and be respected in daily life, especially inside the Republic of Indonesia’s territory which embraces Pancasila and 1945 Constitution.

  2. Death penalty execution to the three convicts is far beyond justice because the lack of material truth on this case, as we can see on the reality that new facts (novum) had never been regarded even in the reconsideration trial by five supreme court’s judges on May, 9th 2006. The accusation to the three convicts was not true. How come these men attacked Moengko complex, which was their own religious prayer house and also school and dormitory complex for their own children. Therefore, the accusation on what the three convicts did in Moengko complex is unacceptable as truth.

  3. In this appeal we strongly refuse death penalty execution to the three convicts. We believe that the verdict is still far beyond justice and there is still lack of material truth in it.

  4. We strongly appeal to adjourn death penalty execution until our representatives in the House of Reperesentative finish processing the new criminal law draft (RUU KUHP).

  5. Mistake made in executing soul and life of the three convicts which were gift from the divine one God will bring bad image on Indonesian court and law enforcement system and also will disgrace government’s and this nation’s reputation among countries all over the world.

We do hope that all law enforcement officers pay attention to this appeal and take any necessary follow up. We also direct this appeal to those who concern with Tibo, Marianus and Dominggus’ humanitarian case.
